Eight years after Super Typhoon Haiyan, the most destructive storm to ever hit the Philippines, Super Typhoon Rai brought similar torrential rains, violent winds, mudslides, floods and storm surges to central parts of the Philippines, leaving a wide path of destruction and debris in its wake. While ...not as powerful as Haiyan in terms of wind strength, evidence shows that Rai damaged houses, infrastructure and livelihoods on a comparable scale or in even greater numbers. Most striking, Rai damaged 1.57 million homes, 500,000 more than Haiyan, across 11 of the Philippines 17 regions, with around 180,000-200,000 people still displaced – either still in evacuation centers or staying with friends, family or other temporary housing.

It is a pressing question for donors and NGOs alike: is funding development and humanitarian work in fragile and conflict-affected states (FCAS) the equivalent of pouring money into a bottomless pit, if achievements are only going to be undone by further cycles of violence? The domestic regulation of public health emergencies (PHEs) is inextricably linked to the regulation of other types of disaster. PHEs are usually governed at least partly by general disaster and emergency laws. Moreover, there is significant overlap in the legal mechanisms used to respond to PHEs an...d other types of disaster, including the declaration of a state of disaster or emergency and the use of emergency powers. Even where PHEs are regulated by separate instruments, those instruments must surmount many of the same policy and practical challenges as general disaster laws, such as finely balancing competing considerations (e.g. speedy response versus due process), facilitating the coordination of a multitude of actors, and protecting the most vulnerable within society. Finally, many contemporary developments in disaster risk management (DRM), such as a greater emphasis on risk reduction and preparedness, are just as pertinent to PHEs as to other types of disaster.
